Congress Must Impose Oversight on ICE After the Killing of Renée Good

I am a constituent writing to demand congressional action to address constitutional and statutory failures in Immigration and Customs Enforcement (ICE) enforcement operations and detention practices. ICE is an administrative agency, not a general-purpose police force. Yet its current practices increasingly involve armed street enforcement, warrantless seizures, and prolonged detention—raising serious Fourth Amendment and Fifth Amendment concerns. Multiple court records and findings by the Department of Homeland Security’s Office of Inspector General document patterns of arrests without judicial warrants, denial of access to counsel, unsafe detention conditions, and prolonged confinement without meaningful due process. These failures are no longer abstract. On January 7, 2026, Renée Nicole Good, a U.S. citizen and mother, was fatally shot by an ICE agent during an enforcement operation in Minneapolis. The use of lethal force during an administrative immigration action—particularly against a civilian not accused of a violent crime—exposes a dangerous regulatory vacuum. ICE lacks a statutory framework governing armed operations, lethal-force accountability, and independent review comparable to those imposed on traditional law-enforcement agencies. Congress is responsible for this vacuum. Absent clear statutory limits, enforceable standards, and independent oversight, ICE is operating beyond its intended authority with predictable and deadly consequences. I am asking you to state your position and take action on the following: • Will you support legislation requiring judicial warrants for ICE arrests and prohibiting enforcement actions at sensitive locations, including homes, schools, hospitals, courthouses, and shelters? • Will you support independent, mandatory investigation of any injury or death resulting from ICE operations, with public reporting requirements? • Will you oppose ICE funding increases unless Congress establishes enforceable limits on armed enforcement authority and detention practices? • Will you support community-based alternatives to detention that meet court-appearance requirements without unnecessary incarceration? Respect for law enforcement derives from adherence to the law itself. When an administrative agency exercises coercive power without clear limits or accountability, Congress has an affirmative duty to intervene. I expect a public response outlining your position and the specific legislative or oversight actions you will pursue. I will be tracking both your response and your voting record on ICE oversight.
