I am writing to urge you to stand firm against President Trump’s increasingly dangerous efforts to undermine the balance of powers and reshape our nation in a way that threatens the Constitution you are sworn to uphold. His use of the Alien Enemies Act of 1798 to target and deport alleged gang members—many without criminal records or due process—is not only an abuse of executive authority, it is a violation of core American principles (The Guardian, April 2025).
This maneuver exploits an outdated law meant for times of declared war, not political expediency. The administration is using it as a blunt instrument to bypass judicial review and accelerate deportations, sending people—many uncharged with crimes—to harsh detention centers in countries like El Salvador (The Times UK, April 2025). There is no serious attempt to distinguish between gang members and innocent individuals, which erodes due process and threatens the liberty of anyone labeled an “enemy” by the executive branch.
President Trump has also repeatedly lashed out at judges and court rulings that challenge his authority, characterizing judicial checks as partisan interference. The Constitution was built to prevent exactly this kind of consolidation of power. The Court must not allow its legitimacy to be weaponized or ignored.
I urge you—whether you lean originalist or progressive, whether appointed by a Republican or Democrat—to recognize that granting this President any leeway will only result in further abuses. He has shown that he will bend any legal opening to serve his own agenda, with no regard for the long-term consequences to our democratic institutions. Do not allow him to reshape our republic into something the Founders would not recognize and the American people will not tolerate. The future of our democracy demands your courage.
