Fix the Damages Cap in HB9155 Before It Reaches the Floor

Pass HB9155, the CONSENT Act, but fix the damages cap before it reaches the floor. The bill's $1,000 statutory damages ceiling is too low to deter anyone with resources. Someone who sends or posts unsolicited intimate imagery, including AI-generated deepfakes, faces a financial exposure inconsistent with the damage they cause. The rest of the bill is solid. It creates a federal civil cause of action, covers synthetic content like deepfake pornography, includes attorney fee shifting to make litigation accessible for victims, and requires no federal appropriations. These are meaningful provisions, but a damages ceiling that doesn't sting won't change behavior. Raise the statutory cap to a figure that actually reflects the psychological harm victims suffer, and this bill becomes a genuine deterrent rather than a symbolic one.
