To My Representatives in Congress: YOU are preparing to confirm to confirm an Attorney General based on a comfortable FICTION, abandoning institutional accountability to rubber-stamp a nominee who refuses to legally bind the executive branch. The Department of Justice must operate under strict constitutional authority, not unilateral, easily reversible memos designed solely to secure confirmation votes. CONFIRMED, IMMUTABLE FACTS: Acting Attorney General Todd Blanche issued a unilateral DOJ order rescinding the $1.8 billion anti-weaponization fund. The underlying May 2026 arrangement establishing the fund and tax exemptions was a multi-party settlement agreement. The DOJ released an order acknowledging the tax audit settlement is limited to the plaintiffs and IRS/Treasury defendants. The President publicly stated that if Blanche is not confirmed, the fund will "immediately be back on the table." FORWARD-LOOKING ANALYSIS & SYSTEMIC INDICTMENT: The assurances provided to the Senate Judiciary Committee fail to resolve core illegalities: Failure to Negate the Fund: A unilateral DOJ directive rescinding a previous order does not legally amend the underlying, binding multi-party settlement agreement. Legally closing this loophole requires a formal amendment signed by all original litigants, including the President. Without this, the executive branch retains the mechanical capability to revive the slush fund post-confirmation. Failure to Counter Tax Immunity: Narrowing the scope of the tax audit exemption does not legitimize it. As Brandon DeBot of the Tax Law Center noted, narrowing who is covered "would not fix its fundamental flaws" and the order "would still be unauthorized." The DOJ lacks statutory authority to grant tax audit exemptions for unreferred tax matters in a privacy lawsuit. STRATEGIC LEVERAGE AND ULTIMATUM: Your position in Congress provides the leverage needed to halt this overreach. Use your procedural power to demand a formal, multi-party amendment to the settlement agreement that permanently strips the unauthorized tax immunity and legally dissolves the fund. Vote NO on advancing the nomination of Todd Blanche.
