I am writing to express my strong opposition to the “Promptly Ending Political Prosecutions and Executive Retaliation Act.” This proposed legislation amends 28 U.S. Code § 1442, the federal officer removal statute, and allows federal cases to be removed from state courts to federal courts. This is a deeply troubling bill, and I believe it represents an alarming shift toward granting the president the ability to evade legal accountability, regardless of whether he is breaking the law. By enabling a sitting or former president (or vice president) to remove cases “for or relating to any act while in office”—even those involving personal or private conduct unrelated to their official duties—the bill effectively provides immunity to those in the highest office of the land. This is an unprecedented overreach and a dangerous step toward granting the president unbridled power to act outside of the law without consequence. It undermines the very foundation of our democratic system, which was built on checks and balances, and makes a mockery of the separation of powers. For this reason, I cannot help but think that anyone supporting this bill either believes the president is preparing to commit crimes or treason, or they are willing to provide him a legal shield to act without oversight. This bill does not just undermine justice; it encourages a dangerous precedent for future abuses of power. The president must be held accountable for his actions, and it is the responsibility of Congress to ensure that this happens. Furthermore, the bill is a clear violation of the Constitution, which mandates a careful balance of power between the federal and state governments. It infringes on states’ rights by granting federal courts jurisdiction over state cases, undermining state sovereignty in favor of a centralized federal system that we were never meant to have. The idea that a president could wield such power with no accountability, effectively positioning himself above the law, is a threat to the rule of law itself. In light of this, I respectfully urge you to stand against this bill. It is not only a political move but a dangerous one that risks the integrity of our democracy. We should not allow the office of the presidency to become a tool for legal immunity or, worse, a vehicle for treasonous actions. The people elected you to uphold the Constitution, and this bill would do the opposite.
