I am writing to express my deep concern regarding the upcoming Supreme Court consideration of Kim Davis' challenge to same-sex marriage on November 7, 2025. This case has the potential to threaten the fundamental human rights of countless Americans, and I urge you to use your influence to protect marriage equality.
In 2015, the landmark Obergefell v. Hodges decision recognized the constitutional right to same-sex marriage. This ruling was a pivotal moment for civil rights in our nation, affirming the dignity and equality of LGBTQ+ individuals. However, Kim Davis, a former Kentucky county clerk, defied this ruling by refusing to issue marriage licenses to same-sex couples, citing her personal religious beliefs.
The consequences of Davis' actions were significant. David Moore and David Ermold, who were denied their legal right to marry, sued and were each awarded $50,000 in damages by a jury in 2023. The 6th Circuit Court rightly rejected Davis' appeal, stating that her actions as a government official were not protected by the First Amendment.
Now, Davis is petitioning the Supreme Court to not only review this decision but potentially overturn Obergefell. This is a dangerous attempt to roll back hard-won civil rights. The court's decision to grant review hinges on whether four justices vote to take up the question and if they believe there is a fifth vote to overturn Obergefell.
I implore you to speak out against this challenge and advocate for the protection of same-sex marriage rights. The potential overturning of Obergefell would have devastating consequences for countless families across our nation. It would create legal chaos, invalidate existing marriages, and send a message that LGBTQ+ Americans are second-class citizens.
As your constituent, I ask that you publicly affirm your support for marriage equality and use your platform to influence the Supreme Court's decision. Urge them to reject this challenge and uphold the constitutional rights of all Americans, regardless of their sexual orientation.
