An open letter to the U.S. Congress

Protect academic freedom, check DHS overreach on universities

The actions taken against Harvard University by the Department of Homeland Security (DHS) under Secretary Noem are concerning. Threatening to revoke the university's ability to enroll foreign students and terminating grants worth millions of dollars raise serious issues regarding academic freedom and overreach of federal authority. The demand for records on visa holders' activities under the guise of investigating "illegal and violent activities" appears to be a thinly veiled attempt to suppress free speech and peaceful protest on campus. Universities have internal disciplinary processes to address violations of their codes of conduct, which should remain independent from government interference. Furthermore, the request for personal information on foreign students likely violates the Family Educational Rights and Privacy Act (FERPA), which protects the privacy of student records. Harvard would be justified in refusing to comply with such a demand, as it would compromise the rights of its students and undermine the university's commitment to fostering an open and diverse learning environment. Congress must take action to curtail this abuse of power by the DHS. Holding Secretary Noem accountable for her actions would send a clear message that the federal government cannot encroach upon the autonomy of academic institutions or infringe upon the rights of students, foreign or domestic. Preserving the ability of universities to attract and educate talented individuals from around the world is crucial for maintaining America's position as a global leader in higher education and innovation. Allowing the DHS's overreach to continue unchallenged would set a dangerous precedent and undermine the very principles of academic freedom and intellectual discourse that have made American universities world-renowned.
