This case, set for consideration on November 7th, has the potential to threaten the hard-won rights of same-sex couples to marry.
The 2015 Obergefell v. Hodges ruling was a landmark decision that finally recognized the fundamental right of same-sex couples to marry. It brought joy and legal protection to countless families across our nation. Now, just eight years later, this right is potentially at risk. While overturning Obergefell is not guaranteed even if the Court takes the case, the mere consideration of this challenge sends a chilling message to LGBTQ+ Americans.
I urge you to use your position to publicly advocate for the rejection of this case and to reaffirm your commitment to marriage equality. The Court needs four votes to take on the case, and your voice could influence this critical decision. If the Court denies the case in the first conference, we could see a result as early as November 10th. However, if accepted, it may take over a week for an announcement, prolonging uncertainty for many Americans.
It's crucial to remember that this is not just a legal issue, but a human rights issue affecting real families in our community. While the Respect for Marriage Act provides some federal protections, a reversal or weakening of Obergefell would be devastating for same-sex couples and their children.
