An open letter to State Legislatures (Minn. only)

Oppose HF 2809 - Residential Protesting Ban Threatens First Amendment Rights

30 so far! Help us get to 50 signers!

I urge you to vote against HF 2809 when it comes before the House Public Safety Finance and Policy Committee on Wednesday, February 18. This legislation, sponsored by Rep. Walter Hudson and more than two dozen Republican lawmakers, would criminalize protesting on or in front of residences with penalties ranging from misdemeanors to gross misdemeanors and restraining orders. This represents an unacceptable erosion of First Amendment protections. The right to peaceful protest is fundamental to our democracy. While I understand concerns about privacy and residential peace, existing laws already address harassment, trespassing, and disorderly conduct. Creating a new crime specifically targeting protest activity based on location sets a dangerous precedent for restricting constitutionally protected speech. The timing of this bill is particularly troubling. Since December 1, 2025, Minnesota has seen widespread protests opposing Operation Metro Surge and federal immigration enforcement tactics. These demonstrations followed the shooting deaths of Renee Good and Alex Pretti by federal officers and included protests at a St. Paul church that resulted in journalist arrests, including former CNN anchor Don Lemon. This legislation appears designed to silence dissent during a period of significant public concern about government overreach. The bill's narrow exceptions for meetings in common areas or protests at residences that double as businesses reveal its true purpose: suppressing specific types of political expression rather than protecting genuine safety concerns. If someone's actions cross the line into intimidation or threats, law enforcement already has tools to intervene. Chipping away at First Amendment rights to address what existing statutes already cover is both unnecessary and dangerous. Once we begin carving out exceptions to free speech based on convenience or discomfort with particular viewpoints, we undermine the constitutional protections that safeguard all Minnesotans regardless of political affiliation. I ask you to oppose HF 2809 and protect the constitutional rights of your constituents to engage in peaceful protest.
