Support legislation that prevents the transfer of the Office of Special Education and Rehabilitative Services (OSERS) or any IDEA responsibilities out of the Department of Education, and oppose any effort to weaken the educational protections Congress established for students with disabilities.
A bipartisan group of senators, former Republican and Democratic special education leaders, educators, and disability organizations have warned that transferring special education responsibilities to the Department of Health and Human Services is inconsistent with the purpose of IDEA and threatens the coordinated educational protections students rely on. Parents need educational experts overseeing special education—not another layer separating these programs from our schools.
IDEA guarantees every child with a disability a free appropriate public education. It is an education law, not a healthcare program. Congress intentionally placed special education oversight within the Department of Education because educating children with disabilities requires expertise in curriculum, instruction, accommodations, inclusion, transition services, and educational accountability. Special education belongs with educators in the Department of Education—not within a health agency.
