Charge Benjamin Netanyahu in U.S. Courts for War Crimes and Genocide

We call on you to demand that the U.S. Department of Justice arrest and charge Israeli Prime Minister Benjamin Netanyahu for the murders of American citizens in Gaza and for war crimes across the occupied West Bank, Lebanon, Yemen, and Iran. The evidence is overwhelming. The International Criminal Court issued arrest warrants for Netanyahu and former defense minister Yoav Gallant in November 2024 for war crimes and crimes against humanity, including intentionally depriving Gaza's civilians of food, water, medicine, and fuel. Over 73,000 Palestinians have been killed. New York City Mayor Zohran Mamdani has rightly called Netanyahu “the architect of a horrific genocide against the Palestinian people” and urged the federal government to enforce the ICC warrant. U.S. courts can act. The U.S. is not an ICC member, but federal law allows prosecution of war crimes and torture under statutes like 18 U.S.C. § 2340. The Center for Constitutional Rights has documented “overwhelming” evidence supporting charges against Netanyahu. If Nicolás Maduro can be arrested in New York on drug charges, then Netanyahu—wanted for crimes against humanity—must face justice here too. The hypocrisy is undeniable. For Palestinians in Gaza and Palestinian New Yorkers, this is survival. Genocide survivors who have relocated to New York from Gaza's “open-air prison” are watching. Palestinian-American communities across our state have mobilized, with candidates winning on platforms of defunding “Israel's genocide in Gaza”. They demand accountability—not empty words. To those who say this is politically impossible: Voters are demanding action. To those who say it undermines allyship: complicity with genocide is not allyship. To those who say the ICC is enough: the U.S. must enforce international law, not evade it. We believe no war criminal should find safe harbor in New York.
