I urge you to oppose SB1058 when it comes before the Senate Public Safety Committee on Wednesday. This bill would prohibit financial institutions from using merchant category codes that identify firearms retailers or purchases of guns and ammunition, creating serious practical problems while undermining both public safety tools and free market principles. Merchant category codes serve as an important mechanism for identifying potentially suspicious purchasing patterns that could indicate illegal activity, including straw purchases or stockpiling before mass violence events. Law enforcement and financial institutions rely on these standard business codes to flag transactions that warrant further investigation. Eliminating this tool removes a layer of protection that helps prevent gun-related violence without infringing on lawful purchases. Beyond public safety concerns, SB1058 creates a significant compliance problem for businesses operating in Arizona. Payment platforms including Zelle, PayPal, and Venmo prohibit firearms and ammunition transactions under their terms of service. Without merchant category codes to identify these purchases, businesses cannot effectively enforce these contractual restrictions. This bill would force companies to choose between operating in Arizona and maintaining their nationwide business policies, potentially driving payment services out of the state or exposing them to liability for violations of their own terms. The legislation interferes with private sector business decisions about how companies categorize and manage transactions. Financial institutions developed these codes as standard business practice to manage risk, prevent fraud, and comply with various legal obligations. Banning their use represents government overreach into private commercial operations and contradicts principles of free market competition. The claim that merchant category codes could lead to a gun registry is unfounded. These codes simply identify the type of merchant, similar to codes for grocery stores or gas stations. They do not create databases of individual gun owners or specific firearms purchased. I ask that you vote no on SB1058 in committee. This bill solves a problem that does not exist while creating real obstacles for law enforcement, financial institutions, and businesses trying to operate responsibly in Arizona.
