Constitutional Concerns: April 28 Executive Order on Law Enforcement

As your constituent, I write with serious concerns about President Trump’s April 28, 2025 Executive Order regarding law enforcement. This order appears to exceed presidential authority in several ways that merit congressional oversight and potential legislative response.
The Executive Order contains provisions that may:
1. Encroach on state and local authority over law enforcement (Sections 3 and 5).
2. Threaten prosecution of local officials based on vague standards (Section 5).
3. Potentially militarize local policing through increased transfer of military assets (Section 4).
4. Create mechanisms for federal intervention in local policing without clear congressional authorization.
While ensuring public safety is vital, the separation of powers and federalism are fundamental constitutional principles that must be respected. Congress has an essential oversight role when executive actions potentially exceed authority or threaten constitutional boundaries.
I respectfully request that you:
• Examine whether this order exceeds presidential authority under existing statutes.
• Consider holding oversight hearings to review implementation.
• Ensure appropriations align with congressional intent rather than potentially unconstitutional directives.
• Work to preserve the appropriate balance between federal authority and state/local control.
I am particularly concerned about the provisions that could lead to targeting of state and local officials based on policy disagreements rather than clear violations of federal law.
Our democratic system depends on maintaining appropriate checks and balances. I hope you will take this oversight responsibility seriously, regardless of party affiliation.
