An ethical crisis within the Supreme Court threatens to undermine public faith in the entire judicial branch. We must pass the Supreme Court Ethics, Recusal and Transparency Act as it would help rebuild public trust in the judiciary by holding Supreme Court justices to the highest ethical standards, creating clear standards for recusal, and bringing transparency to the judiciary’s opaque practices.
The Supreme Court Ethics, Recusal, and Transparency (SCERT) Act requires justices of the Supreme Court to adopt and follow a code of ethics, places transparency standards on gifts and travel, codifies recusal standards, and requires the Court to disclose lobbying and dark money interests.
Even the American Bar Association agrees and recently adopted Resolution 400: https://www.americanbar.org/news/reporter_resources/midyear-meeting-2023/house-of-delegates-resolutions/400/
Similarly, a group of two dozen legal ethics scholars recently penned a letter asking the Court to implement a formal code of conduct: https://www.scribd.com/document/556480364/Scholars-Letter-on-SCOTUS-Ethics-Code
