Your Oath of Office Requires Action on Executive Defiance of Court Orders

I write to urge you to take immediate action in response to the executive branch’s refusal to comply with the Supreme Court’s unanimous order in Noem v. Abrego Garcia, Docket No. 24A949. Mr. Kilmar Abrego Garcia, a lawful Maryland resident, remains imprisoned in El Salvador despite a binding court mandate requiring his return.
The administration admits the deportation was unlawful and yet has not corrected the violation. Mr. Abrego Garcia is still being held in a prison the U.S. helps fund. Officials claim they have done “all they can,” but this is demonstrably false. The U.S. has both the diplomatic tools and economic influence to bring him back—if it chooses to use them.
This situation exemplifies the authoritarian character of the current administration: open defiance of the courts, abandonment of the rule of law, and contempt for the Constitution.. It is a moment that demands strong action from every person and institution committed to democratic values. As a member of Congress, your oath to uphold the Constitution compels you to act.
I urge you to speak out publicly, demand enforcement of the Court’s ruling, and use your full authority to hold the administration accountable.
