The proposed 10-year moratorium on state regulation of artificial intelligence systems raises significant concerns about undermining states' ability to promptly address risks or unintended consequences from the rapid development of this powerful technology. Federal preemption without robust public input prioritizes business interests over public safety. States must maintain flexibility to enact guardrails reflecting local needs as AI evolves. Removing the problematic provision preserves regulatory authority for a balanced, transparent approach giving communities a voice. Failure to do so benefits wealthy tech firms at the public's expense while eroding democratic governance of transformative technologies. Moreover, limiting states' rights on AI could enable further federal overreach on other issues, progressively diminishing states' powers regardless of which party controls Congress.
