These consolidated cases challenge the constitutionality of Executive Order 14160, which seeks to restrict birthright citizenship—a right enshrined in the 14th Amendment. As guardians of our constitutional order, I urge you to uphold the Constitution and reject this overreach.
America was founded to prevent the concentration of absolute power. The Constitution ensures that no branch, including the executive, operates above the law. The Framers meticulously designed a system of checks and balances to safeguard against tyranny. By attempting to redefine the 14th Amendment, the president seeks to bypass the Constitution, Congress and the Judiciary, thereby undermining this separation of powers.
The 14th Amendment declares, “All persons born…in the United States, and subject to the jurisdiction thereof, are citizens.” This principle was affirmed in United States v. Wong Kim Ark (1898), establishing the constitutional guarantee of birthright citizenship. The administration's claim defies clear constitutional text and longstanding precedent. Permitting this reinterpretation would erode the rule of law and accelerate a shift toward autocratic governance.
The administration also challenges the use of nationwide injunctions—a vital judicial tool for ensuring uniform rights across the country. Undermining this mechanism would not only embolden executive overreach but also fragment legal protections across states. We are the United States; the law must speak with one voice in defense of our shared rights.
