The Fourth Amendment Is Not Optional — Rein in ICE NOW!

To: Sen. Cornyn, Pres. Trump, Rep. Carter, Sen. Cruz

From: A constituent in Leander, TX

January 25

This letter is a direct reminder of a basic, non-negotiable fact: the Fourth Amendment to the United States Constitution is real, binding, and still the law of the land. The Fourth Amendment does not evaporate because an agency finds it inconvenient. It does not bend to political pressure. And it does not disappear simply because ICE has decided it is above constitutional limits. Yet ICE’s actions increasingly reflect a dangerous and unlawful disregard for this fundamental right. Warrantless stops. Illegal searches. Home and workplace intrusions without probable cause. Intimidation tactics that rely on fear instead of law. These are not “enforcement tools.” They are constitutional violations. Let me be absolutely clear: No federal agency has the authority to suspend the Constitution. Not ICE. Not DHS. Not the Executive Branch. The Fourth Amendment exists precisely to prevent this kind of abuse of power — government agents acting without warrants, without accountability, and without respect for due process. What we are witnessing now is not enforcement; it is erosion of civil liberties under the color of law. Congress has both the authority and the obligation to act. Silence is not neutrality — it is complicity. You must: • Conduct immediate, public oversight hearings into ICE’s search, seizure, and detention practices • Enforce strict compliance with warrant and probable cause requirements • Hold agents and leadership accountable for constitutional violations • Rein in corruption and abuse before this damage becomes irreversible The President likewise has a sworn duty to faithfully execute the laws of the United States — including the Constitution. Allowing or encouraging constitutional violations is a betrayal of that oath. The Fourth Amendment is not a suggestion. It is not optional. And it is not suspended by fear, politics, or convenience. Rein in ICE now — before “constitutional rights” become empty words instead of enforceable law. The American people are watching. History is watching. And excuses will not be accepted.
