Oppose the NO FAKES Act

To: Rep. Mannion, Sen. Schumer, Sen. Gillibrand

From: A verified voter in Syracuse, NY

June 17

Oppose the NO FAKES Act. What started as a narrow bill targeting AI-generated replicas has ballooned into a sweeping censorship and innovation-suppression law that will cause serious collateral damage to free expression online. The updated bill mandates content filters across platforms — filters that already fail badly under copyright law, flagging non-infringing content and ignoring fair use context. NO FAKES would make these broken systems a legal requirement. Worse, it lets anyone obtain a subpoena from a court clerk, with no judge and no proof, to unmask anonymous users. That's a ready-made tool for silencing critics. Congress just passed the Take It Down Act targeting intimate AI content — we should see how that plays out before layering on another sweeping internet regulation. The real winners here are Big Tech incumbents, who are reportedly comfortable with this version of the bill. That should tell you everything. New services and independent developers will face impossible compliance costs and liability triggered by bare allegations. Vote no on the NO FAKES Act.
