Legislative proposal: Protecting workers from uncompensated device mandates

To: Rep. Bonamici, Sen. Wyden, Sen. Merkley

From: A constituent in Portland, OR

October 1

I am writing to you today as your constituent to urge your attention and legislative action on a growing trend of corporate overreach: the mandatory use of personal mobile devices for workplace security and operations without financial compensation. Increasingly, employers are requiring staff to download corporate authenticator apps, multi-factor authentication (MFA) tools, and mobile device management (MDM) software onto their personal smartphones as a condition of employment. While cybersecurity and administrative verification are important, this practice forces employees to subsidize their employer's IT infrastructure. When a company requires an employee to use their personal property for commercial operations, it blurs the boundary between private life and employment, exposes personal devices to administrative friction, and shifts legitimate business operating costs onto workers who are already navigating rising costs of living. Several states have enacted robust expense-reimbursement laws ensuring that employees are compensated for the business use of their personal phones, but federal standards remain inadequate. I urge you to support and champion legislation that protects workers by: 1. Mandating Compensation: Requiring employers who mandate the installation of work-related apps or security software on personal devices to cover a reasonable, proportional percentage of the employee's monthly phone and data bill. 2. Protecting Privacy Boundaries: Establishing clear legal protections that separate personal data and device integrity from corporate surveillance or control. Thank you for your time, your public service, and your consideration of this important workplace protection issue.
