Vote no on the GUARD Act when it reaches the Senate and House floor. This bill creates a national identity system that forces every American to hand over government IDs, facial scans, or financial records just to ask a chatbot a question.
The bill's definition of "AI chatbot" is so broad it captures customer service bots, search assistants, and homework helpers. Compliance will require companies to either store sensitive documents in databases that become targets for cybercriminals or force users to repeatedly re-upload their IDs. NetChoice warned these requirements create "honeypots ripe for cybercriminals to exploit through breaches, identity theft and fraud."
The GUARD Act offers no parental consent option. Parents cannot authorize their own children to use these tools. Users flagged as underage are simply locked out, with no appeals process for errors. Meanwhile, $100,000 per-offense penalties will drive smaller developers out of the market, consolidating power among tech giants who can absorb verification costs.
This surveillance infrastructure applies to all users regardless of age. The Judiciary Committee's 22-0 vote happened without addressing these fundamental privacy violations. Reject this bill and any age verification mandate that treats every American like a suspect.
