Investigate and Block the Fifth Circuit's Assault on Detention Due Process

To: Sen. Cornyn, Sen. Cruz, Rep. Casar

From: A constituent in Manor, TX

October 24

Investigate the conditions inside immigration detention facilities and act to restore bond hearing rights stripped by the Fifth Circuit's ruling in Sosnava Rodriguez v. Ortega. This decision allows the government to lock people up indefinitely, with no obligation to justify the detention and no path for the detained person to challenge it before a judge. That is not a technicality. That is the architecture of disappearance. The three fathers at the center of this case have lived in this country for years, raised U.S. citizen children, and contributed to their communities. They were taken from their families and locked up without ever seeing an immigration judge. The government is already transferring people into Texas, Louisiana, and Mississippi specifically to place them beyond the reach of due process. There is no tracking, no accountability, and now no legal recourse. History is clear about what happens when a government can detain people without explanation, without review, and without record. This ruling does not just threaten immigrants. When courts hollow out liberty for some, the precedent is available to use against anyone. Restore bond hearing rights. Do it now, before the machinery already in motion becomes impossible to stop.
