This bill reasserts the fundamental principle that no one, including the President or Vice President, is above the law or immune from criminal prosecution for violations of federal criminal laws. It clarifies that Presidents and Vice Presidents have no absolute, presumptive, or other form of immunity from facing charges for criminal acts committed while in office. The proposed legislation responds to a concerning Supreme Court ruling that granted broad immunity to former Presidents for official acts. By limiting the judiciary's ability to dismiss charges or halt prosecutions on grounds of official duties, and by explicitly denying any presumption of immunity, this bill upholds the notion of equal justice under the law. It is a necessary step to reinforce that leaders are accountable to the same laws as all citizens, preserving the rule of law and balance of powers. This measure should be supported to prevent any President, such as Donald Trump, from evading consequences for criminal actions under the guise of executive authority.
