The Supreme Court ruled that President Trump's tariffs levied under the International Emergency Economic Powers Act are unconstitutional. Rather than complying with this ruling, the President announced a 10% tariff on foreign imports immediately after the Friday decision, then raised it to 15% on Saturday. On February 23, he posted that the Supreme Court had given him more powers than before and claimed he could "do absolutely terrible things to foreign countries." This defiance of a Supreme Court ruling represents a constitutional crisis that demands immediate Congressional intervention.
The consequences are already severe. Bernd Lange, head of the international trade committee in the European Parliament, called this "pure tariff chaos" and the European Parliament voted to pause approval of its trade deal with the United States. India postponed a trip to finalize a trade agreement. These actions are isolating America from our trading partners and damaging our economic standing.
The American people overwhelmingly reject this approach. An ABC News/Washington Post/Ipsos poll found that 64% of Americans disapprove of Trump's handling of tariffs, and 82% of Americans, including 76% of Republicans, believe the president must obey Supreme Court rulings. Half of Americans say Trump's policies have hurt the economy versus only 26% who say they helped. The stock market has fallen sharply due to uncertainty about these tariff threats.
Speaker Mike Johnson acknowledged that Congress has no appetite for Trump's desired tariffs, calling it "a challenge to find consensus on any path forward on the tariffs, on the legislative side." This is the moment for Congress to act decisively. I urge you to support legislation that explicitly prohibits the implementation of tariffs that the Supreme Court has ruled unconstitutional and reasserts Congressional authority over trade policy as outlined in the Constitution. The rule of law and our economic stability depend on it.
