I am writing to you today as a voting constituent to express support for the Daniel Ellsberg Press Freedom and Whistleblower Protection Act. This critical legislation seeks to reform the outdated Espionage Act of 1917—a law that has been increasingly weaponized to silence whistleblowers and intimidate the journalists who report on government misconduct. As reported in recent coverage of this bill, the Espionage Act was originally intended to target foreign spies, yet it has been used by administrations to prosecute individuals who act in the public interest. By doing so, the government has created a chilling effect on investigative journalism, effectively shrouding government decision-making in secrecy and undermining our First Amendment rights. The Daniel Ellsberg Press Freedom and Whistleblower Protection Act addresses these issues through several vital reforms: Establishing a Public Interest Defense: It allows whistleblowers to testify about their motives and prove that their disclosures were intended to benefit the public rather than harm the nation. Requiring Proof of Intent: The bill mandates that the government prove a defendant acted with the "specific intent" to harm the United States or aid a foreign power, ensuring that those exposing war crimes or corruption are not treated as traitors. Protecting Journalists and Publishers: It limits the scope of the Espionage Act to government employees with a legal duty to protect classified information and foreign agents, explicitly exempting journalists and members of the general public from prosecution under the Act. Modernizing Standards: It ensures the law applies only to "properly classified" information, preventing the government from using "national defense" as a vague catch-all for any information it wishes to keep hidden. Journalism is not a crime; it is a pillar of our democracy. Without the bravery of whistleblowers like the late Daniel Ellsberg and the work of diligent journalists, many of the most significant abuses of power in our history would remain hidden from the American people. I urge you to stand up for government transparency, the free press, and our constitutional rights by co-sponsoring this legislation and working toward its swift passage.
