Reinstate Delta-8 Hemp Products and End This Costly Legal Battle Reinstate delta-8 and other hemp-derived THC products in Texas immediately, and stop wasting taxpayer money defending a ban that's already facing a federal lawsuit. Two hemp retailers and a distributor just filed suit in the U.S. District Court for the Southern District of Texas, arguing the ban violates the 2018 Farm Bill and imposes an unconstitutional burden on interstate commerce. That case is going to cost Texans money we don't need to spend. This is a multibillion-dollar industry built on products that were completely legal in this state for years. Without any change to the underlying laws, the state is now calling these Schedule I drugs — the same classification as heroin. That's not a drug policy; that's prohibition dressed up in bureaucratic confusion. Over 14,000 licensed retail stores stand to lose products from their shelves, and Texans who've done nothing wrong are now facing felony charges carrying up to two years in prison. The smarter path is clear: legalize, regulate, and tax cannabis products. Texas is leaving enormous revenue on the table while simultaneously funding a losing legal fight. Stop the ban, drop the prosecution, and work toward a framework that actually serves Texans.
