Trump Pardoned Men Who Beat Police. Now He’s Indicting for a Photo Seashells

On April 28, 2026, the DOJ indicted James Comey for the second time. The charge was posting a photo of seashells on a beach. The shells spelled “86 47.” Comey deleted the post the same day, writing that he didn’t know “some folks associate those numbers with violence” and that he “opposes violence of any kind.” Conservative commentator Jack Posobiec posted “86 46” about Joe Biden. Michigan Governor Gretchen Whitmer appeared on camera with an “86 45” figurine. Neither was investigated. Acting AG Todd Blanche, Trump’s former personal defense attorney, held a press conference to announce the charges three days after the Correspondents’ Dinner shooting. The Supreme Court ruled in 2023 that prosecuting a threat requires proving the person understood their message would be perceived as threatening. Comey deleted the post and explained himself publicly the same day.
Now look at what this administration considers protected speech. On January 6, 2021, Trump used the word “fight” nearly two dozen times at the Ellipse, ending with “If you don’t fight like hell, you’re not going to have a country anymore.” His lawyer Rudy Giuliani told the same crowd “Let’s have trial by combat.” Trump then watched for hours as supporters beat 140 police officers and hunted lawmakers through the Capitol. Five people died that day. Trump called the rioters “great patriots” and told them to “remember this day forever.” He pardoned them. In 2019, the El Paso shooter killed 23 people at a Walmart. His manifesto cited the “Hispanic invasion of Texas.” Trump had run over 2,000 Facebook ads using that word in the months before the attack. The shooter’s attorney told the court his client believed he was “acting in the direction of the president.” Nobody was charged for that rhetoric. Nobody held a press conference.
This isn’t about protecting the president from threats. It’s about punishing people he doesn’t like. Pass the DOJ Independence Act. Hold hearings on the selective use of threat statutes against political opponents. Demand an independent review of every prosecution brought against Trump’s named adversaries since January 2025. A president who pardons men who beat police officers, then indicts a man for photographing seashells, has stopped enforcing the law. He’s abusing the law for his benefit.
