Protect Michigan Water & Cancel Data Center Permits
To: Rep. Bergman, Sen. Peters, Sen. Slotkin
From: A constituent in Beulah, MI
July 31
I am writing as your constituent to demand immediate legislative and regulatory action regarding hyper-scale corporate data centers. Facilitating these massive facilities through special tax carve-outs and fast-tracked environmental permits directly infringes upon the public interest, constitutional rights, and local self-governance. Hyper-scale data centers violate our fundamental rights by: 1 Infringing on Article IV, Section 52 of the Michigan Constitution: Which mandates that the conservation of state natural resources, air, and water is of paramount public concern, requiring protection from pollution, impairment, and destruction. 2 Violating Public Trust and Water Rights: Diverting millions of gallons of public water for corporate cooling operations degrades local watersheds and threatens community water security. 3 Subverting Procedural Due Process & Local Autonomy: Expedited permitting, administrative "minor source" loopholes for heavy diesel/gas generators, and state-level overrides strip communities and local governments of meaningful notice, public comment, and zoning control. 4 Imposing Unlawful Economic Burden: Shifting grid expansion costs and inflated energy prices onto residential utility ratepayers violates the principle of fair utility regulation. I urge you to introduce and pass legislation that will: • Revoke and Nullify Permits: Immediately cancel and revoke all existing, pending, or fast-tracked state and local permits—including air quality permits for backup generators, water withdrawal authorizations, land-use approvals, and utility grid interconnections—issued to hyper-scale data centers. • Repeal Tax Exemptions: Terminate all state sales, use, and property tax exemptions granted to enterprise data center equipment and facilities (including Public Acts 181 and 207). • Impose a Complete Permitting Moratorium: Halt all new site applications and approvals until independent environmental, hydrological, and utility-rate impact studies are completed. • Enforce Daily Fines and Personal Executive Liability: Enact civil penalties of up to $100,000 per day for operating or constructing unauthorized facilities, holding corporate officers personally liable for non-compliance. Our laws and natural resources exist to protect the health, welfare, and rights of citizens—not to subsidize resource-intensive corporate infrastructure. I ask that you take action to revoke these permits and pass these enforcement measures immediately.
