I am writing to express my strong opposition to HB 224, the bill that would criminalize individuals for intentionally approaching or remaining within 100 feet of a first responder during an emergency situation. This legislation poses a serious threat to Alabamians' First Amendment rights by restricting the ability of the public to observe and record law enforcement and emergency response activities. Documentation has historically played a critical role in exposing misconduct and holding public officials accountable. The vague language of the bill, leaving the determination of the 100-foot distance to officer discretion, increases the likelihood of selective enforcement and abuse of power. The public should not have to fear criminalization or retaliation for exercising their constitutional rights to monitor government actions. This bill would have a chilling effect on free speech and transparency in our state. I urge you to vote against HB 224 and protect the fundamental rights of Alabamians. This legislation is an overreach of authority that undermines crucial civil liberties. Please stand up for the First Amendment and reject this attempt to criminalize public presence near first responders.
