Oppose Anti-Trans Laws That Threaten Rights for All

I am writing to urge you to oppose anti-transgender legislation and policies that threaten fundamental rights not just for transgender people, but for everyone in our community. The Supreme Court is currently hearing two cases, Little v. Hecox and West Virginia v. BPJ, that expose the dangerous reach of anti-trans arguments. During oral arguments, Justice Amy Coney Barrett raised a critical concern about mandating sex segregation based on inherent differences. She asked whether evidence showing women outperform men in math would justify segregating women from advanced math classes. Justice Elena Kagan extended this question to chess clubs. These hypotheticals reveal how anti-trans legal theories could justify rolling back decades of progress for women's equality across education, employment, and public life. West Virginia Solicitor General Michael Williams argued such scenarios would fail due to lack of evidence of meaningful physiological differences. Yet this reasoning ignores that anti-trans sports bans rely on the same flawed logic of biological essentialism. The underlying assumption is that there exists a universal scientific or legal definition of two binary sexes, which does not actually exist. This framework can be weaponized to restrict opportunities for all people based on sex stereotypes. Khadijah M. Silver, Director of Gender Justice and Health Equity at Lawyers for Good Government, warned that decisions in these cases could be read expansively to erase trans people's legal right to exist. Tekla Taylor of Advocates for Trans Equality noted that allowing states to discriminate against trans girls under Title IX would contradict the original feminist intent behind Title IX to expand opportunity and dismantle sexist stereotypes. When we allow discrimination against one group based on rigid biological categories, we create legal precedents that can justify discrimination against anyone. I urge you to publicly oppose anti-trans legislation and support policies that protect equal rights under the Fourteenth Amendment for all constituents.
