The Laken Riley Act (H.R. 29/S.5) threatens to undermine due process rights and disproportionately impact vulnerable communities like DACA recipients. The mere allegation of wrongdoing, without upholding the presumption of innocence, could lead to detention and deportation proceedings against individuals who have not been convicted of any crime. This approach fails to address the root causes of violence and instead scapegoats immigrant communities that statistically have lower crime rates than the native-born population. Protecting DACA recipients and preventing future tragedies requires comprehensive, evidence-based solutions that uphold civil liberties and human rights for all. Rather than advancing this flawed legislation, efforts should be directed towards developing fair policies that enhance public safety while respecting due process guarantees.
