If Tariff Refunds Go to Corporations, Consumers Deserve Restitution

The Supreme Court has ruled that the tariffs imposed under the International Emergency Economic Powers Act were unlawful. That means the federal government collected billions of dollars under an invalid legal authority. Those tariffs were not absorbed by corporations. They were passed directly to American consumers in the form of higher prices on goods, components, and everyday household items. Multiple economic analyses over the past several years — including work from the Federal Reserve, academic trade economists, and the Congressional Budget Office — have documented that U.S. consumers bore the overwhelming share of the cost of these tariffs through price increases. If the government now refunds those collections to importers without addressing the downstream price burden already paid by households, Congress will be authorizing a corporate windfall funded by American families. If a tax was unlawfully imposed, restitution should follow the economic burden — not merely the technical payer at the port of entry. As your constituent, I am asking for the following: 1. Public disclosure of the total tariff revenue collected under the invalid authority. 2. Full transparency regarding who is receiving refunds. 3. Legislation requiring that refunded tariff revenue be offset by: • A direct consumer rebate, • A refundable tax credit, or • A structured dividend to U.S. households. If businesses passed the costs on — and evidence strongly indicates they did — then refunding them alone amounts to double recovery at the public’s expense. This is not a partisan issue. It is a fairness issue. It is a restitution issue. Unlawful government action should not end in corporate enrichment while households who paid higher prices receive nothing. I expect a written response outlining your position and any legislative steps you intend to take
