I am writing as your constituent to urge you to oppose the recent Senate provision in the "Big Beautiful Bill" that would require anyone challenging the federal government in court to post a massive upfront bond, with no exceptions—even in cases where civil rights are at stake.
This provision would make it nearly impossible for ordinary people, civil rights groups, nonprofits, and environmental watchdogs to hold the government accountable. Judges would not be allowed to waive or lower the bond, regardless of whether someone’s rights are being violated or if the plaintiff is a nonprofit or lacks financial resources.
The details are deeply concerning:
Courts would have to set a bond based on the potential cost or harm to the government if it loses.
Judges would be explicitly barred from considering whether the plaintiff is poor, a nonprofit, or has clear evidence of rights violations.
Even a bond of $50,000 or $100,000 could bankrupt small organizations or individuals before their case is heard.
This creates a paywall to justice, effectively shielding the government and large corporations from public accountability. It would prevent whistleblowers, disabled veterans, grieving parents, and environmental groups from challenging unlawful or harmful government actions simply because they cannot afford the bond.
Please vote NO on this harmful provision and protect the rights of all Americans to seek justice and hold their government accountable.
