I am writing as a concerned resident of Cedar Rapids to express my strong opposition to House File 639 (HF 639), recently passed by the Iowa Legislature. While I understand that the bill aims to address issues related to hazardous liquid pipelines and eminent domain, I believe that certain provisions within HF 639 may have unintended consequences that could negatively impact our state’s energy infrastructure and economic development. One of my primary concerns is that the bill imposes stringent requirements on pipeline companies to qualify as “common carriers,” necessitating “clear and convincing evidence” of public use. While safeguarding property rights is essential, these heightened standards could hinder the development of critical energy projects that benefit the broader public. By making it more challenging for companies to obtain necessary permits, we risk stalling projects that could enhance our state’s energy independence and economic growth. Additionally, the bill’s provision to limit the operational period of carbon dioxide pipelines to 25 years and prohibit permit renewals may deter long-term investments in carbon capture and storage technologies. These technologies are vital for reducing greenhouse gas emissions and combating climate change. Restricting their development could impede Iowa’s progress toward a more sustainable and environmentally friendly energy sector. Furthermore, while the bill expands the rights of individuals to intervene in Iowa Utilities Commission proceedings, it may also lead to increased litigation and delays in project approvals. This could create an uncertain regulatory environment, discouraging businesses from investing in our state. In light of these concerns, I urge you to consider the potential economic and environmental implications of HF 639. While protecting landowners’ rights is crucial, it is equally important to ensure that our policies do not inadvertently hinder progress in energy innovation and infrastructure development. Thank you for your attention to this matter. I respectfully request that you veto HF 639 to allow for further deliberation and the development of more balanced legislation that addresses the needs of all stakeholders.
