This provision limits courts’ ability to hold the executive branch in contempt for ignoring injunctions or restraining orders unless a security bond was provided—a rare requirement in such cases. I urge you to oppose this section due to its threat to the separation of powers.This restriction undermines the judiciary’s role in checking executive overreach. Legal scholar Erwin Chemerinsky has called it a “terrible idea,” warning it renders court orders “unenforceable” (Just Security). The provision’s retroactive scope could also disrupt ongoing cases, like those on immigration (Substack, Heather Cox Richardson). Long-term, it empowers any president—current or future—to bypass judicial oversight, weakening the rule of law.As your constituent, I ask you to:Oppose Section 70302 by advocating for its removal or amendment.Raise awareness about its risks among colleagues and the public.Protect judicial independence by ensuring courts retain enforcement powers.This is not a partisan issue but a defense of our Constitution’s balance.
