Under the Trump administration, senior Justice Department officials and allied legal groups have threatened criminal charges against any “sanctuary” jurisdiction that refuses to assist in federal immigration enforcement—seeking to criminalize state and local autonomy . The U.S. Supreme Court has already rebuffed these federal assaults, affirming state prerogative to set enforcement priorities without fear of prosecution  . To protect our democracy and uphold the rule of law, I urge you to pass legislation that will: • Establish a Dedicated Sanctuary Defense Fund: Allocate substantial annual funding to cover legal defense costs, indemnify fines, and reimburse any penal damages against public officials or municipalities enforcing New York’s sanctuary laws. • Codify Official Indemnification: Enact statutes guaranteeing that any state or local official sued for sanctuary compliance is immune from personal financial liability and is fully covered by the state. • Prohibit Cooperation with Unlawful Federal Demands: Bar state agencies and employees from complying with any federal subpoena or warrant that conflicts with state sanctuary statutes, subject to legislative review. • Create a Rapid‑Response Legal Team: Task the Attorney General’s office with forming a specialized legal strike team ready to defend New York officials in any federal court action. These measures are essential to prevent federal intimidation from silencing local leaders and eroding the rights of immigrant communities. New York must lead by example, demonstrating that we will not bow to unconstitutional federal overreach or threats of prosecution. Your urgent action on this mater is imperative.
