Pass the Bodily Sovereignty Act: Codify Roe v. Wade

To: Sen. Peters, Sen. Slotkin, Rep. Bergman

From: A constituent in Beulah, MI

June 25

The reversal of Roe v. Wade is not merely a crisis of healthcare access—it is a direct, fundamental assault on bodily autonomy. When the government claims the authority to dictate reproductive choices, it crosses a dangerous line into treating human beings and their families as property of the state. We are entirely done with an administration and a legal system that treats our bodies, our private medical choices, and our children as assets to be monitored, tested, and exploited for political and corporate leverage. Furthermore, we are done with government officials acting with impunity, relying on state-sponsored legal shields to escape accountability when they actively violate the civil rights of the people they serve. Congress must act immediately to strip the state of this overreach, permanently codify absolute bodily sovereignty, and establish severe penalties for any state actor who breaches these constitutional boundaries. The Constitutional Violations: Forcing individuals to surrender control of their physical bodies, invading the privacy of families, and shielding abusive government actors directly violates the core principles of the United States Constitution: • The Fourteenth Amendment (The Right to Liberty and Privacy): The Constitution explicitly guarantees that no state shall "deprive any person of life, liberty, or property, without due process of law." True liberty cannot exist without absolute control over one's own physical body. The right to absolute privacy in medical and family choices is an unalienable component of American freedom. • The Fourth Amendment (Protection Against State Intrusion): The escalating use of corporate data dragnets, digital surveillance, and tracking networks to monitor private family health decisions and intercept the data of our children is a flagrant violation of the right to be secure from unreasonable government intrusion. The Demand: I demand that Congress immediately exercise its legislative authority to pass the Women's Health Protection Act (WHPA) and attach comprehensive bodily sovereignty and strict criminal accountability protections that permanently ensure: 1 Absolute Protection of Bodily Sovereignty: Explicitly recognize that the human body is sovereign and is not the property, testing ground, or data source of the state. 2 An End to the Exploitation of Children and Families: Prohibit any federal or state agency from enacting invasive tracking mandates, forced data collection, or surveillance dragnets that seek to gain unauthorized access to the bodies, personal health choices, or biological data of citizens and their children. 3 Ironclad Nationwide Reproductive Access: Establish an explicit statutory right for healthcare providers to offer, and patients to receive, comprehensive reproductive care completely free from restrictive, state-level bans or manufactured hurdles. 4 The Elimination of Political Stumbling Blocks: Outlaw unnecessary state-mandated restrictions, such as forced waiting periods or arbitrary facility requirements, which are designed solely to act as state-sponsored intimidation against people seeking care. 5 Classification as a Blatant Civil Rights Violation and the Abolition of Qualified Immunity: Explicitly classify any state or local restriction on reproductive freedom and bodily autonomy as a blatant, actionable federal civil rights violation under Title 42, Section 1983. Because these are fundamental civil rights, Congress must completely strip away "qualified immunity" protections for these offenses. No government official, law enforcement agent, or state lawmaker shall be shielded from personal liability when they intentionally weaponize state power to violate a citizen's bodily sovereignty. Victims must have an unhindered right to sue individual abusive officials directly in federal court for full compensatory, punitive, and financial damages. Our bodies and our children belong to us—not to a political administration, a state legislature, or a government database. I urge you to stand up for fundamental constitutional liberty, reject this culture of government ownership, strip abusive officials of their legal immunity for these blatant civil rights violations, and vote to put the protections of reproductive freedom and absolute bodily autonomy permanently back on the books.
