Dear Senators and Representatives, We, the undersigned, write to you with grave concern regarding the recent Executive Order on “Ensuring Accountability for All Agencies”, which consolidates the power of legal interpretation within the hands of the President and the Attorney General. This unprecedented move undermines the foundational principle of separation of powers and threatens the democratic framework upon which our nation was built. The Danger of This Executive Order 1. Usurping the Judiciary’s Role – The order prohibits executive branch employees from presenting any legal interpretation that contradicts the President or Attorney General, effectively stripping the courts of their authority in executive matters. This erodes judicial independence and sets a dangerous precedent for unchecked executive power. 2. Bypassing Legislative Intent – Congress writes laws with the expectation that they will be implemented based on their original intent, with regulatory agencies applying them fairly. By consolidating interpretative authority, the Executive Branch could reinterpret laws at will to serve political ends, regardless of congressional intent. 3. A Path Toward Authoritarianism – History has shown that when leaders gain unchecked control over legal interpretation, democracies crumble. This move mirrors the Reichstag Fire Decree (1933) and Enabling Act (1933) in Nazi Germany, Erdogan’s 2017 constitutional changes in Turkey, and Stalin’s judicial purges in the Soviet Union, all of which led to the consolidation of power in the executive. Our Demands We urge Congress to take immediate legislative action to: • Pass a resolution condemning this executive order as an unconstitutional overreach. • Introduce and pass legislation reaffirming the judiciary’s sole authority in interpreting federal laws and executive actions. • Protect the autonomy of regulatory agencies to ensure laws are interpreted based on congressional intent and not executive decree. • Demand oversight hearings to investigate the implications of this order and ensure it does not undermine constitutional governance. This is not a partisan issue; it is a matter of protecting the constitutional balance of power. No president—now or in the future—should have the unchecked ability to dictate the meaning of laws without judicial or congressional oversight. We call upon you, as our elected representatives, to defend the Constitution, uphold democracy, and take swift action to prevent this dangerous consolidation of power.
