Oppose Invasive Biometric Data Collection in Immigration Process

To: Rep. Pingree, Sen. King, Sen. Collins

From: A constituent in Damariscotta, ME

November 5

**Oppose Invasive Biometric Data Collection in Immigration Process** I am writing to express my strong opposition to the Department of Homeland Security's proposed rule to expand biometric data collection from immigration applicants. This invasive policy change raises serious human rights concerns and disproportionately impacts vulnerable populations, including transgender and nonbinary individuals. The proposed rule would mandate extensive biometric information, including DNA testing, fingerprints, and facial and iris scans, from nearly all applicants and individuals associated with immigration-related requests. This sweeping collection of sensitive personal data goes far beyond reasonable security measures and infringes on the privacy and bodily autonomy of immigrants and their families. Of particular concern is the impact on transgender and nonbinary individuals. Biometric data collection, especially facial scans and DNA testing, can be deeply distressing and potentially dangerous for those whose gender identity may not align with their appearance or genetic markers. This policy could force individuals to disclose their transgender status or subject them to misgendering, discrimination, and increased risk of violence. The rule's elimination of age limits for biometric collection is especially troubling, as it would subject children to invasive procedures without clear justification. Furthermore, the shift to a 'person-centric' approach and the expanded authority to collect biometrics following arrests raise serious questions about due process and the presumption of innocence. I urge you to take immediate action to oppose this rule. Please advocate for the protection of privacy rights, human dignity, and the fair treatment of all individuals in our immigration system. We must ensure that our policies reflect our values of inclusivity and respect for human rights, rather than subjecting vulnerable populations to unnecessary and potentially harmful surveillance. The consequences of inaction are severe. If implemented, this rule would create a dangerous precedent for government overreach and could lead to further erosion of civil liberties for both immigrants and citizens alike. I ask that you publicly speak out against this proposal, submit a formal comment opposing the rule, and work with your colleagues to prevent its implementation. Our immigration policies should focus on creating fair, efficient, and humane processes, not on expanding invasive surveillance measures that threaten individual rights and target marginalized communities. I look forward to hearing about your efforts to protect the rights and dignity of all individuals in our immigration system.
