Preserve the Presidential Records Act!

To: Sen. Durbin, Rep. Budzinski, Sen. Duckworth

From: A constituent in Urbana, IL

April 3

What is your perspective on the the April 1st pronouncement by Office of Legal Counsel opinion asserting that the Presidential Records Act (PRA) is unconstitutional? This claim—that Congress lacks authority under Article I to require preservation and transfer of presidential records—raises previously unchallenged questions about transparency, accountability, and the balance of powers. Since 1978, the PRA has served as a safeguard ensuring that official presidential actions are documented and ultimately accessible to the public. If this framework is abandoned, in accordance with the opinion of Attorney General T. Elliot Gaiser, what mechanism will preserve an accurate historical and legal record of executive decision-making? Do you agree with this interpretation? If not, what steps do you believe Congress should take to reaffirm its authority and protect the integrity of presidential records? I will appreciate your thoughts on this matter and any actions you intend to pursue.
