The Trump administration's staff cuts at the Department of Education, including in the Office for Civil Rights, threaten to severely limit the ability of families with children with disabilities to seek remedies for violations of their rights. The Office for Civil Rights investigates complaints of discrimination against students with disabilities, which have historically been the largest portion of its caseload. However, with a depleted staff directed to prioritize other issues, the backlog of disability discrimination cases is mounting without timely investigations. This leaves families who cannot afford legal representation with diminished recourse through the federal complaint process. The dismantling of this avenue for families signals a troubling indifference to protecting the civil rights of students with disabilities and upholding their right to an equitable education. Urgent action is needed to restore the staffing and enforcement capacity to properly address discrimination against this vulnerable population of students.
