I'm deeply alarmed regarding the potential for federal overreach through the forced federalization of our state's National Guard under Title 10 authority. While the President has constitutional power to activate Guard forces, recent events highlight the importance of preserving state control wherever legally and strategically possible.
Legal experts and recent reporting (e.g., Washington Post, Brennan Center) emphasize that although federal activation may be lawful, it can be resisted or delayed through political, legal, and administrative means. Additionally, strengthening our State Defense Force-as allowed under 32 U.S.C. § 109—can help ensure that our state retains a responsive, sovereign military capacity that cannot be federalized.
I urgently request your active support in ensuring that the Governor’s office takes immediate, proactive steps to protect Hawai‘i’s constitutional authority and retain operational control over our National Guard.
