Ban Forced Arbitration

To: Sen. Cantwell, Rep. Jayapal, Sen. Murray

From: A constituent in Seattle, WA

September 5

Companies are using Terms and Conditions to take away our rights. Unfortunately, often the only way an individual can hold a corporation accountable is through our legal system, but that right is being taken away by forced arbitration agreements and similar contracts that take away our right to sue. There was an infamous story of Kanokporn Tangsuan who died after being given food at Disneyland that she was allergic to despite confirming several times with the staff that the food was safe for her to eat. They couldn’t sue because of a clause in the terms and conditions of a Disney+ trial they had signed up for years prior. Similar to banning anti-compete clauses in employment contracts, we need to ban clauses that take away a persons right to sue. Otherwise we will live in a world where no corporation can be held accountable when they cause harm.
