I need you to launch an immediate investigation into the abuse of presidential pardon power related to January 6 defendants. The recent case of Daniel Tocci exposes a dangerous pattern that demands congressional oversight.
Tocci received a pardon from President Trump for his Capitol attack crimes. Law enforcement had discovered over 100,000 child sexual abuse images on his laptop during the January 6 investigation. He just received four years in prison for child pornography possession, but he walked free on the insurrection charges that led to that evidence being found in the first place.
This isn't an isolated incident. Andrew Paul Johnson, another pardoned January 6 defendant, was sentenced to life in prison for child sex crimes. He allegedly used promises of money from a supposed Justice Department settlement to silence his victims. Trump has publicly discussed compensating January 6 rioters, though no payments have materialized yet.
The Justice Department is applying inconsistent standards under this administration. They've argued that gun crimes stemming from January 6 investigations should be dismissed, but not child pornography cases. Trump even re-pardoned one defendant over a gun case in 2024.
Congress must investigate whether the pardon process was manipulated to shield serious criminals and whether any coordination exists between the administration and pardoned defendants regarding promised compensation.
