Congress must reassert its constitutional authority to determine the applicability of federal criminal laws, including to presidents. The Supreme Court's ruling in Trump v. United States incorrectly granted absolute or presumptive immunity to presidents for official acts, contradicting the intent of the Founders. The No Kings Act clarifies that no president is above the law and can face criminal prosecution without special immunity, as Alexander Hamilton affirmed in Federalist No. 69. The Act also limits the Supreme Court's jurisdiction over such cases to prevent further erosion of this principle. By passing this legislation, Congress upholds the critical doctrine that presidents are not sovereigns exempt from the rule of law.
