I am writing to share an article by Jewish Currents titled "Human Shields: Gaza, Israel, and a Legal Justification for Genocide." The article details disturbing practices and legal justifications used by the Israeli government and military in their operations in Gaza, which have resulted in massive civilian casualties and widespread destruction. The article outlines how the concept of "human shields" is being exploited to justify the indiscriminate targeting of civilian areas. This practice violates international law and raises serious ethical and moral questions about military operations in densely populated areas. The repeated use of this justification appears to be a deliberate strategy to excuse actions that would otherwise be considered war crimes. Despite claims that Hamas uses civilians as human shields, evidence shows that the Israeli military has repeatedly targeted densely populated areas, leading to high civilian casualties. This includes the bombing of residential buildings and critical infrastructure, disproportionately affecting women and children. The systematic targeting of essential infrastructure, such as water and electricity facilities, hospitals, and schools, has exacerbated the humanitarian crisis in Gaza. The article details how the Israeli government has used legal arguments to defend its actions, claiming that any area where Hamas operates is a legitimate military target, regardless of the presence of civilians, raising serious questions about the proportionality and discrimination of these military operations. Historical examples are highlighted in the article, such as the 1911 bombing of medical facilities in Libya by Italian pilots, which generated criticism but was defended by the Italians as “authorized by international law.” This justification has been used throughout the 20th century in various conflicts to excuse attacks on protected sites and people. At the ICJ, Israel has used the human shields defense to justify a colonial war of annihilation, aiming to legitimize the destruction of entire neighborhoods and communities under the pretext of combating terrorism, disregarding the immense human cost. As an elected official, it is your responsibility to ensure that our country does not support or condone such practices. I urge you to: 1. Demand an Immediate and Permanent Ceasefire and Return of All Hostages & Political Prisoners From Both Sides 2. End Military Aid to Israel 3. Refund UNRWA 4. Work to End Israel’s Illegal Occupation of Palestine The continued suffering of civilians in Gaza, justified through legally and morally questionable means, cannot be ignored. It is imperative that we stand firmly against such practices and advocate for justice and accountability.
