Safeguarding Civilian Elections: Urgent Need for Military Cyber Oversight

To: Sen. Peters, Sen. Slotkin, Rep. Moolenaar

From: A constituent in Mesick, MI

October 29

Petition for Independent Congressional and International Oversight of Domestic Military Cybersecurity Actions I am writing as a constituent to express deep concern regarding the unprecedented 50-state mobilization of National Guard cyber units for domestic infrastructure monitoring. While protecting our election architecture from foreign interference is vital, deploying military intelligence and cyberspace assets across all 50 states creates a serious risk of federal overreach, a lack of transparency, and the potential infringement of civilian data privacy. The American civic and voting process must remain strictly civilian-led. Allowing military cyber operations to interface with domestic networks without robust, public, and independent check-and-balance systems sets a dangerous precedent that challenges the spirit of the Posse Comitatus Act. Therefore, I urge you to immediately take the following actions through the House Committee on Oversight and Accountability and the Senate Committee on Homeland Security and Governmental Affairs: 1 Launch Formal Inquiries: Convene immediate, public oversight hearings to investigate the full operational scope, rules of engagement, and legal authorities granted under the current 50-state National Guard cyber mobilization directive. 2 Establish Clear Data Guardrails: Implement strict, binding protocols ensuring that no domestic citizen data, network traffic logs, or private communication metrics are collected, stored, or analyzed by military or defense intelligence personnel. 3 Mandate Independent Civilian Audits: Require the Department of Defense to submit comprehensive, unclassified reports to Congress detailing all network interventions, system access points, and specific actions taken by Guard cyber units within civilian infrastructure. 4 Integrate International Oversight: Invite independent international election and human rights monitoring bodies (such as the Organization for Security and Co-operation in Europe's Office for Democratic Institutions and Human Rights) to observe and evaluate the transparency and boundaries of these domestic military cyber actions, ensuring they fully align with global democratic standards and do not interfere with civilian voting processes.
Our digital defense must not come at the expense of transparency, civil liberties, or civilian control of our democratic institutions. I request a formal response detailing the specific steps you plan to take to ensure rigorous domestic and international oversight on this matter.
