After the Supreme Court decided against Donald Trump in Learning Resources v Trump that declared his tariffs unconstitutional, he has said, multiple times, that he does not intend to follow the orders of the court. This is not the first time he has openly defied court orders. A president refusing to abide by the decisions of the courts puts us into a constitutional crisis, without a system of checks and balances. Although I understand that Democrats have the minority in Congress, and that any attempt at impeachment will fail as long as Republicans remain complicit in the president’s lawlessness, it is still the job of Congress to work to uphold the constitution. So, even though impeachment not passing seems to be a forgone conclusion, it is still vital that articles of impeachment are filled. By not doing so, Democrats are by default saying that it’s fine to break the law and disregard the constitution. Trump has committed multiple impeachable offenses during this second term, and they have mostly gone by without consequences because Democrats argue they don’t have the votes to impeach. That doesn’t matter. The process of trying to maintain the law must still be followed, even if it will fail. Failure to do so is what has normalized Trump’s increasingly unlawful behavior. Congress must act now.
