I am writing to express my deep concern over the ongoing negotiations regarding the extension of Affordable Care Act (ACA) subsidies. It has come to my attention that there are efforts to include anti-transgender provisions in these negotiations, specifically a ban on using federal funds for transgender healthcare in ACA subsidized plans. This proposal is not only discriminatory but also potentially harmful to millions of Americans.
The enhanced ACA subsidies currently benefit approximately 20 million people across the country. Introducing restrictions on transgender healthcare would create a dangerous precedent and could harm transgender individuals even in states that are typically supportive of LGBTQ+ rights. Such a ban would effectively create a conflict between federal subsidy rules and state laws that require coverage of gender-affirming care.
As your constituent, I strongly urge you to oppose any attempts to include anti-transgender provisions in the ACA subsidy extension negotiations. These provisions are reminiscent of Hyde Amendment-style restrictions and have no place in our healthcare system. Rep. Sarah McBride of Delaware has rightly criticized these potential provisions as dangerous and discriminatory.
The inclusion of such measures would not only be a step backward in terms of civil rights and healthcare equity but could also create complex legal and administrative challenges. It is crucial that we maintain a healthcare system that is inclusive and respects the medical needs of all Americans, regardless of their gender identity.
I ask that you take a firm stand against any proposals that would ban or restrict coverage for transgender healthcare in ACA plans. Please work to ensure that the final agreement on ACA subsidies protects and upholds the rights of transgender individuals to access necessary medical care. The health and well-being of many of your constituents depend on your advocacy in this matter.
