I am writing to demand that Congress take immediate, bipartisan legislative action to strengthen the checks and balances governing executive emergency powers. In a healthy democracy, a transition of power must be dictated strictly by the constitutional election process—not by administrative or institutional disruptions.
We must ensure that no administration, regardless of political party, can weaponize a national crisis, infrastructure challenge, or national security event to delay, interfere with, or alter the outcome of a democratic election. Furthermore, we must prevent federal agencies, the military, or private corporate entities from being used to facilitate a consolidation of authority within the executive branch during a presidential transition.
I urge you to support legislation that:
1 Requires Immediate Congressional Review: Automatically terminates any presidential emergency declaration within 48 hours unless explicitly approved by a joint vote of Congress.
2 Protects Election Administration: Explicitly prohibits the deployment of federal troops or the invocation of the Insurrection Act for domestic law enforcement or election monitoring during a transition period.
3 Guarantees Infrastructure Independence: Mandates that civilian utility providers, banking networks, and telecommunications corporations remain under local, decentralized control and cannot be overridden by executive orders during an election cycle.
The peaceful transfer of power is the foundation of our republic. Congress must act now to place unbreakable legal guardrails around emergency declarations so they can never be used as a political tool.
